Fransam Homes Landlord/Agent Agreement

This Landlord/Agent Agreement ("Agreement") governs the use of the Fransam Homes platform ("Platform") by landlords, property owners, and real estate agents ("User"). By creating an account or using any service on the Platform, the User agrees to be legally bound by the terms set out below.
1 Purpose of the Agreement
The purpose of this Agreement is to establish clear terms, rules, and responsibilities for landlords and agents using the Fransam Homes platform to advertise, manage, and transact property listings. The Agreement ensures trust, transparency, verified listings, and secure interactions between landlords, agents, and prospective tenants.
2 Acceptance of Agreement
2.1 Acceptance of this Agreement is mandatory before account creation.
2.2 By clicking "Accept," registering an account, or listing a property, the User confirms that they have read, understood, and agreed to all terms herein.
2.3 This Agreement is legally binding and enforceable upon acceptance.
3 User Verification
3.1 Identity Verification
- All landlords and agents must submit valid identification for profile verification.
- Accepted documents include National ID, Voter's ID, or Passport.
- Submitted documents must be clear, valid, and belong to the account holder.
- Fransam Homes reserves the right to reject, request re-submission, or suspend accounts with incomplete, false, or misleading identification.
3.2 Account Approval
- Accounts remain inactive until verification is completed and approved.
- Approval grants access to post unlimited property listings at no cost.
3.3 Property Verification
- Every property or unit listed on the Platform must undergo verification before being made visible to users.
- Verification may include physical inspection, documentation review, or digital confirmation.
- Listings found to be false, duplicated, or misleading will be removed.
4 Responsibilities of Landlords and Agents
4.1 Provide accurate, truthful, and up-to-date information for all property listings.
4.2 Ensure properties listed are legally owned, managed, or authorized for rent or sale.
4.3 Upload genuine images, descriptions, pricing, and availability details.
4.4 Maintain professional, respectful, and lawful conduct when interacting with tenants.
4.5 Comply with all applicable housing, tenancy, and property laws within Ghana.
4.6 Promptly update listings when a property is rented, sold, or no longer available.
5 Communication and Booking Protocols
5.1 All communications between landlords/agents and prospective tenants must occur strictly within the Fransam Homes platform.
5.2 All bookings, inspections, reservations, and agreements must be initiated and managed through the Platform.
5.3 Directing users to transact or communicate outside the Platform is strictly prohibited.
5.4 Any attempt to bypass the Platform may result in suspension or permanent account termination.
6 Fees and Account Use
6.1 Account registration and property listings are currently free unless otherwise stated.
6.2 Fransam Homes reserves the right to introduce service fees or premium features in the future with prior notice.
7 Privacy and Data Protection
7.1 Fransam Homes collects and processes user data in accordance with applicable data protection laws.
7.2 Personal information submitted for verification will be used strictly for security, compliance, and platform operations.
7.3 User data will not be shared with third parties without consent, except where required by law.
8 Prohibited Activities
Users must not:
- Post false, deceptive, or misleading property information
- List properties without authorization
- Harass, threaten, or defraud users
- Use the Platform for unlawful purposes
- Attempt to manipulate verification or platform systems
9 Consequences of Non-Compliance
9.1 Violation of this Agreement may result in:
- Temporary suspension
- Permanent account termination
- Removal of listings
- Legal action where applicable
9.2 Fransam Homes reserves sole discretion in enforcing penalties.
10 Limitation of Liability
Fransam Homes acts as a listing and facilitation platform and is not a party to tenancy agreements between landlords/agents and tenants. The Platform is not liable for disputes, losses, or damages arising from off-platform conduct or misrepresentation by Users.
11 Amendments
11.1 Fransam Homes reserves the right to modify this Agreement at any time.
11.2 Updates will be communicated through the Platform.
11.3 Continued use of the Platform after updates constitutes acceptance of the revised terms.
12 Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of Ghana.
By registering or using the Fransam Homes platform, the User confirms full acceptance of this Agreement.
